Terms and Conditions

GlobeTalk, a division of Primus Telecommunications Pty Ltd ABN 69 071 191 396, provides prepaid telephone calling card or account services ("Services") on the following terms and conditions ("Terms"). By using the Services you acknowledge that you accept these Terms.

  1. The Services allow you to make telephone calls from within Australia of the call types and to the destinations specified by GlobeTalk to the value of balance in your account subject to compliance with the procedures specified by GlobeTalk and these Terms.
  2. The Services cannot be used to make calls to premium services, 19xx numbers, operator services including directory assistance, 13, 1300, 1800 numbers or any special or other services designated by GlobeTalk.
  3. GlobeTalk may at any time amend or replace these Terms by publishing the new Terms on the GlobeTalk web site. GlobeTalk may, temporarily or otherwise, remove, add to or otherwise vary the destinations to which calls can be made. Calls to some destinations may be of lesser quality or not be available at all times.
  4. You remain responsible to your service provider for all charges in respect of your telephone account other than those call charges specifically covered by the Services. In particular you must pay the call cost for the call made to access the Services; such calls may incur a surcharge if made from a hotel or the like.
  5. GlobeTalk will allow use of the Services by any person who dials a GlobeTalk access number from your GlobeTalk registered phone or who enters your GlobeTalk PIN. It is your responsibility to maintain security of your account.
  6. The charges for use of the Services are those displayed by GlobeTalk on its website, which may be changed from time to time. You should check current rates at the time of a call.
  7. To start a call, your account must have sufficient balance to cover charges for any connection fee and the first minute of the call including any surcharge applicable if for example you are calling from a 1300 or 1800 number. Calls may continue while your balance is sufficient to cover the next minimum call increment.
  8. You may re-charge (top-up) your GlobeTalk account with your credit card, on-line at the GlobeTalk website, via the Main Menu when making a call or by calling GlobeTalk customer service.
  9. We reserve the right to refuse to accept a recharge and to impose maximum and minimum limits on recharges.
  10. Unused value in a GlobeTalk account is not refundable. Your GlobeTalk account will expire 6 months from last use or recharge, unless otherwise specified.
  11. You must not use the Services for resale or in a manner which is illegal, defamatory, fraudulent or offensive.
  12. GlobeTalk may suspend or terminate your account or your access to the Services, without notice, if it reasonably believes it is necessary to prevent fraud or to protect its employees, facilities or services or that the Services have been used fraudulently or unlawfully or contrary to these Terms.
  13. You consent to the use and disclosure of your personal information in the manner described in the Primus Privacy Policy. In order to provide the Services, GlobeTalk may need to distribute your personal information to third parties located in other countries. The laws relating to the collection, distribution and use of your personal information in these countries may be different to the laws of Australia, but GlobeTalk will hold and transmit your personal information in a safe, confidential and secure environment.
  14. The laws of the State of Victoria, Australia apply to these Terms.
  15. You consent to GlobeTalk sending notices or information to any email or other address supplied by you.
  16. The Trade Practices Act and other law may imply into these Terms warranties that cannot be excluded or restricted ("Statutory Warranties"). Subject to the Statutory Warranties all implied conditions, warranties and other provisions in relation to the Services are excluded. Because of the nature of telecommunications, GlobeTalk is not able to and does not give an implied warranty that any call will be continuous or fault free.
